  • In short–yes. Contrary to popular belief, we always recommend asking for permission, instead of begging for forgiveness later. While it may seem common knowledge that you can remove a tree that grows within, and only in, the bounds of privately owned property, some trees are protected by local council and environmental laws or may cross over onto neighbouring properties and public pathways–meaning a permit to remove it may be required ahead of time.

    If your tree in question grows along or over public thoroughfares, roads, sidewalks, and pedestrian pathways, or it’s shared between two or more private properties, always get advice before lopping the tree. With some large trees spreading over two or more properties, who owns the trees and who has the right to remove (or maintain!) it can be called in question

    If you’re uncertain, we always recommend seeking advice from either an expert arborist team who can conduct tree assessments on your property or calling your local council. Further still, some councils require special permits to remove any trees–no matter who owns them or where they’re found--and may require arborist reports that detail the plan and impact of potential landscaping projects.

    One last important point before considering tree removal: Queensland has some state-wide laws that prohibit the removal of VPO trees–in other words, Vegetation Protected Trees–and the remover could face significant fines if they are caught taking them down.

    A way of preserving natural assets that make up Australia's unique vegetarian and wildlife biosphere, industry standard tree care sees some trees protected by Vegetation Protective orders in Brisbane and Gold Coast. We recommend seriously considering the need for tree removal before investing the time, effort, and resources into lopping services–most especially VPO trees.
